국경조치를 활용한 특허권 보호전략에 관한 연구 - 캐논사의 전략을 중심으로 -

In the global market environment, patent rights are essential intellectual property for securing corporate innovation and core competitiveness. However, at the stage of border measures, patent rights are not sufficiently protected due to the technological complexity of patented inventions and the difficulty of determining infringement. This study analyzes corporate-led strategic approaches to enhancing the effectiveness of patent protection within the framework of border measures. Firms should actively adopt anti-counterfeiting technologies for their products and enhance enforcement efficiency by sharing relevant technical information with customs authorities. In addition, from the stages of product planning and research and development, firms should develop and secure patent technologies that facilitate easier infringement determination. The strategy of Canon represents a typical example in which the effectiveness of border measures is enhanced by incorporating identifiable technological features into product design. In particular, by combining technologies that facilitate infringement determination—such as triangular gear patents, neck-gear patents, and toner supply container patents—with anti-counterfeiting technologies including holograms and proprietary authentication viewers, Canon enables customs authorities to more readily recognize potential infringement, thereby improving the effectiveness of border measures. Accordingly, firms should establish strategies that actively utilize border measures by integrating patent technologies designed for ease of infringement determination with anti-counterfeiting technologies.
